Family/Graduate Housing Terms & Conditions

A student's signature on the Contract for Family and Graduate Housing signifies his/her agreement to and acceptance of the following terms and conditions. Each agreement is personal to the student and cannot be transferred or assigned. These terms and conditions are supplemental to the Contract for Family and Graduate Housing.

1. The contract constitutes an agreement between the University and the named student and his/her spouse, for the rental of University property as the student's residence during his/her course of study.

2. The contract covers the use by the student and his/her family of the leased premises designated here within.

3. The parties understand and agree that the contract embodies the complete understanding of the parties as to their mutual rights and responsibilities in their relationship as lessor and lessee.

4. To be eligible to occupy Family and Graduate Housing, the student must be enrolled full-time (undergraduates - 12 or more hours, graduate students - 9 or more hours). The student must continue to make normal progress toward a degree as determined by the dean of his/ her college or school. The student must also be a single graduate student or part of a family unit, which is defined as a husband and wife with or without children, or a single parent having one or more dependent children who will also reside in the apartment. Single students 23 or older are also eligible for Family and Graduate Housing. Qualifying members of the family unit must be physically present 90 percent of the time.

5. a $100.00 security deposit along with a $45.00 non-refundable application fee must be paid at the time the student submits an application for Family and Graduate Housing. The deposit will be returned to the residents of apartments after the student vacates and it has been determined that the student's account is current and that the apartment has been left in good condition. The University has the discretion to determine whether and how much of the security deposit will be applied to damaged premises. The security deposit may not be applied to the last month's rent.

6. The monthly rent is due on the first day of each month. Exceptions must be approved by the Director of Housing or his/her designee. Rent paid after the 10th of each month is considered delinquent and a fee of 5 percent is assessed. On the 15th day of the month, residents who have not paid their rent will be warned that contract termination proceedings will begin if all delinquent payments are not made and their accounts are not brought to current status within 15 days. Notices of contract termination will be forwarded to residents who have not cleared their accounts within the time specified.

Rent is prorated the first month of occupancy should the student (and spouse) sign a contract after the first of the month. If the date falls after the 15th of the month, the student will be required to pay the prorated amount plus the following month's rent.

7. Termination of the Contract: the student must provide a thirty (30) day advance written notice in order to terminate his/her contract. ("Notice of Intent to Vacate" forms can be obtained from each area Resident Manager or the Family and Graduate Housing Office.) The student shall have the option to terminate his/her contract at the end of any given academic term upon thirty (30) day written notice given prior to such graduation or withdrawal; or for any reason following thirty (30) day written notice to the Family and Graduate Housing Office provided there is a waiting list for prospective tenants in sufficient number to occupy the vacated premises. Such waiting list of those people who have filed applications for Family and Graduate Housing and who are verified to be ready and willing to take up occupancy.

If a replacement is not available, the student shall remain liable for rent until the end of the semester.

8. Termination Due to Change in Status: If only one member of a family is a full-time student, then this contractual agreement will automatically terminate in the month in which the student severs his/her connection with the University or otherwise becomes ineligible for Family and Graduate Housing. If both spouses are full-time students, then the lease will terminate when both become ineligible.

Students who are not eligible for occupancy because of insufficient hours, non-enrollment or change in family status are required to notify the Family and Graduate Housing Office as soon as they are aware that they will no longer be eligible. Students who fail to do so, and have illegally occupied the apartment for twenty (20) days or longer, are subject to having their contracts terminated with a ten (10) day written notice.

If, after a family moves into Family and Graduate Housing, either spouse leaves the household and does not plan to return, written notification must be submitted to the Family and Graduate Housing Office. The remaining spouse becomes ineligible and must vacate within thirty (30) days unless such spouse is a registered, full-time student with a dependent residing in the household.
